1. Acceptance of Terms

By accessing or using shart.app ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Shart.app is a community-driven audio entertainment platform where users can upload, rate, and share audio clips. The Service includes leaderboards, soundboards, user profiles, badges, and related features.

3. User Accounts

You may create an account using supported authentication providers (Auth0, Google, or Microsoft). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may enable two-factor authentication (TOTP) for additional security.

4. User Content

You retain ownership of audio files you upload ("User Content"). By uploading content, you grant shart.app a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content through the Service. You represent that you have the right to upload any content you submit and that it does not violate any third-party rights.

5. Acceptable Use

You agree not to:

Upload content that is illegal, harmful, threatening, abusive, or harassing
Upload non-audio files or files disguised as audio
Attempt to circumvent upload limits, storage quotas, or rate limits
Use automated tools to scrape, download, or interact with the Service
Impersonate another user or misrepresent your identity
Attempt to gain unauthorized access to other accounts or system resources
Interfere with or disrupt the Service or its infrastructure

6. Moderation

Uploaded content may be subject to moderation review before public visibility. Administrators may approve, reject, or remove content at their discretion. Users may report content they believe violates these terms. Repeated violations may result in account suspension or termination.

7. Premium Subscription

shart.app offers an optional premium subscription ("Shart Premium") at $2.99/month, processed through Stripe. Premium benefits include ad-free experience, extended analytics, and additional features. Subscriptions renew automatically. You may cancel at any time through your dashboard or the Stripe billing portal. Refunds are handled per Stripe's policies.

8. Affiliate Links

The Shop page contains affiliate links to third-party products. shart.app may earn a commission on purchases made through these links. Product availability, pricing, and shipping are governed by the respective retailers.

9. Intellectual Property

The Service, including its design, code, logos, and non-user content, is owned by shart.app and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.

10. Account Deletion

You may delete your account at any time from the Dashboard. Account deletion permanently removes all your data, including uploads, ratings, badges, streaks, devices, and profile information. This action cannot be undone.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. shart.app does not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, shart.app shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

13. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated through the Service or via email.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms shall be resolved in the applicable courts.
